- Company (referred to as either "the Company", "We", "Us" or "Our" in this Agreement) refers to MCK Education & Media FZE as well as The English Life Academy and English Life with Benjamin, who are operated by MCK Education & Media FZE, Business Centre, Sharjah Publishing City Free Zone.

- Service refers to the Website.

- Terms and Conditions (also referred as "Terms") mean these Terms and Conditions that form the entire agreement between You and the Company regarding the use of the Service.

- Website refers to The English Life Academy, and English Life with Benjamin, accessible from https://www.englishlifewithbenjamin.com as well as https://the-english-life-academy.circle.so/home.

- You means the individual accessing or using the Service, or the company which is accessing or using the Service, as applicable.

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

These Terms and Conditions apply to all visitors, users and others who access or use the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Section 4. Termination

We may terminate or suspend Your access immediately, without prior notice or liability, for any reason whatsoever, including without limitation if You breach these Terms and Conditions.

Upon termination, Your right to use the Service will cease immediately.

Section 5. Limitation of Liability

To the maximum extent permitted by law, The English Life Academy, its founders, partners, and teachers shall not be held liable for any direct, indirect, incidental, or consequential damages resulting from the use of our services, including but not limited to loss of data, interruption of service, or any other loss.

By using our services, you agree that your use is entirely at your own risk and that you waive any right to seek damages of any kind.

Section 6. Non-Refundable Policy
All fees paid for services, memberships, or classes are non-refundable. By completing your purchase, you acknowledge and agree that all payments are final and that no refunds will be issued under any circumstances, including missed classes, scheduling conflicts, or changes in personal circumstances.

Section 7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates (UAE).

Any disputes arising from or relating to these Terms shall be subject to the jurisdiction of the competent courts in the UAE.

Section 8. Disputes Resolution

If You have any concern or dispute about the Service, You agree to first try to resolve the dispute informally by contacting the Company.

Section 9. Services Offered

The English Life Academy by English Life with Benjamin, and officially registered under MCK Education & Media FZE in the United Arab Emirates, and provides paid memberships that grant access to the following services:

- Live online classes conducted by English teachers;

- Pre-recorded courses and interactive exercises;

- Access to an exclusive learning community;

- Personalised support and guidance;

- Recordings of live classes for later review.

Our membership platform is hosted on Circle.so, and live classes are facilitated via Zoom.com.

Section 10. User Accounts and Memberships

- Users are required to create an account on Circle.so after successfully completing the payment process.

- Memberships are paid and are available at different tiers, each with distinct pricing and benefits. Learn more about the pricing options here.

- Users are responsible for maintaining the confidentiality of their login credentials and must not share their account details with others.

- The Company reserves the right to suspend or terminate accounts found to be in violation of these Terms.

Section 11. Pricing, Payment, and Subscription Terms

- All payments are processed securely via Stripe and must be completed before access to any services is granted.

- Memberships are available on a monthly, quarterly, or yearly subscription basis. Learn more about the membership options here.

- All memberships are set to automatically renew according to the selected billing cycle unless cancelled by the user.

- Users can manage or cancel their subscription at any time through their Circle.so profile settings.

- In the event of a failed payment, the platform will automatically attempt to process the payment multiple times. If the payment remains unsuccessful, access to The Academy will be restricted until payment is received.

- Refunds are not provided under any circumstances. However, users may opt to pause or adjust their membership if necessary.

- The Company does not offer free trials. However, potential members may schedule a free consultation call, provided they have expressed serious interest in joining and have acknowledged their willingness to pay the membership fee.

Section 12. Cancellations and Attendance Policy

- Users must RSVP to reserve their place in live classes.

- Users may only book the number of classes per week included in their selected membership plan.

- Access to classes is only permitted while the user's membership is active and payments are up to date.

- Missed classes cannot be carried over to future weeks or months, regardless of the reason.

- Classes are non-transferable between users and may not be shared, gifted, or moved to another billing period.

- If a user is unable to attend a scheduled class, they must cancel at least 24 hours in advance and notify the Company.

- Late cancellations (less than 24 hours prior to the scheduled class) will result in the class being counted as attended.

- If a user arrives 15 minutes late or more, they will not be permitted to join the Zoom.com session to ensure minimal disruption to the class.

Section 13. Intellectual Property Rights

- All content available on this Website, within The English Life Academy and English Life with Benjamin, and related to any business by MCK Education & Media FZE, including but not limited to videos, courses, exercises, class recordings, and educational materials, is the exclusive intellectual property of the Company.

- Users are strictly prohibited from copying, distributing, reproducing, or sharing any content outside the platform without prior written permission from the Company.

- Any unauthorised use of the Company’s intellectual property may result in legal action.

Section 14. User Conduct and Community Guidelines

To maintain a positive and respectful learning environment, users must adhere to the following guidelines:

- Treat all members, instructors, and staff with courtesy, respect, and professionalism.

- Refrain from using offensive, derogatory, or inappropriate language in any form of communication.

- Do not engage in abusive, harassing, or threatening behaviour, whether written, spoken, or otherwise.

- Respect the privacy and confidentiality of fellow members by not sharing personal information.

- Users must not share login credentials or allow unauthorised individuals to access their accounts.

- Users must ensure that all payments are completed before participating in any classes.

- Users must only book the number of classes they are entitled to according to their membership plan (1 class per week, 2 classes per week, or unlimited). Learn more about the membership options here.

- Users must cancel at least 24 hours in advance if they are unable to attend a scheduled class.

Failure to comply with these rules may result in a warning, temporary suspension, or permanent termination of membership.

Section 15. Amendments to Terms and Conditions

- The Company reserves the right to update, modify, or amend these Terms at any time without prior notice.

- All changes are effective immediately when they are posted.

By continuing to access or use Our Service after those revisions become effective, You agree to be bound by the revised terms. If You do not agree to the new terms, in whole or in part, please stop using the website and the Service.
